Terms & Conditions

We reserve the right and the sole discretion to revise these Terms and Conditions without prior notice.

Access to and use of WiFi and LAN at Apartment 6 of Campo Court, Gharb, and the services available through it are subject to the following terms and conditions.
For ease of reading, “Service” shall be used for either WiFi or LAN access from here on.
By using the apartments Internet you declare that you understand, accept and agree to these Terms and Conditions. These Terms and Conditions supersede all earlier versions. Please read them carefully before activating or using the service.

Definitions

“Service” is a means which enables users of the service to access the Internet as such and the services offered through it using a wireless or wired connection.
“Users” are tenants and their guests who have rented the above mentioned apartment. By using/activating the service you confirm that you are of legal age and agree to be bound by these terms and conditions. Users of minor age need to have the permission of their legal guardians to use the service and the legal guardian hsall be responsible for the minors activities.
If you do not agree to the terms of the agreement, do not use the service. Any use of the service constitutes your acceptance of these Terms and Conditions.

Users

  • agree not to use the service for any illegal purpose, including but not limited to, distribution of computer viruses, hacking into or gaining access to unauthorised sites, and posting or transmitting of any material which is defamatory, offensive, or of an obscene or abusive nature, or for sending unsolicited junk mail (known as “spamming”).
  • agree not to use the service in any manner which constitutes a violation or infringement of copyright or trademark.
  • agree not to use the service to transmit or post any material for the purposes of commercial publicity, commercial promotion or commercial advertising.
  • shall agree that we shall not be liable for any loss or damage whatsoever arising from use of our service. Limitation of liability: Under no circumstances, including, but not limited to, negligence, shall we be liable for any special or consequential damages that result from the use of, or the inability to use, the content and the service available through our service.
  • shall use their own encryption or other security mechanisms to ensure their own privacy of transmitted material.
  • shall still be liable and responsible for the actions and usage carried out whilst they were using the service even when users stop making use of it.

We

  • shall not be liable and will not guarantee any level of service for those services provided by a third party ISP (Internet Service Provider), such as e-mail, storage and backup facilities, secure encryption, electronic commerce transactions, and so on.
  • will not be responsible for any service charges necessary to access the services of third party ISPs.
  • will not be responsible for any loss of information during transit whilst using our service.
  • will not be responsible for the accuracy of any information and quality of internet content made available and accessed through our service by the Users.
  • will accept no liability for the consequences of use of information available on the Internet by service users. Indemnification: you agree to indemnify, defend and hold us harmless from and against all losses, expenses, damages and costs, including reasonable attorney’s fees, resulting from any violation of this agreement or any activity related to your accessing and using our service.
  • will comply with the relevant local Data Protection Laws, and any personal details provided for registration purposes with not be disclosed to any third parties without the User’s consent.
  • reserve the right to deny access to all or any part of the service to any particular user without prior notice if we have due reason to believe that our service is not being used in accordance with these Terms and Conditions.
  • will endeavour to maintain its systems available at all times, however, we cannot guarantee an uninterrupted service. We will not accept responsibility for any interruption of service arising from events beyond its control, including lack of service provided by third parties, network difficulties or electronic malfunction.
  • reserve the right at any time and at our sole discretion to modify, suspend or discontinue, temporarily or permanently, the service (or any part thereof) with or without prior notice.

These Terms and Conditions shall be governed by the Laws of Malta and any disputes shall be exclusively subject to the jurisdiction of the Courts of Malta.
